President Obama nominated Mary L. Smith to be the Assistant Attorney General for the Tax Division on April 20, 2009. A hearing to consider her nomination was held on May 12, 2009. 
On June 11, 2009, the Judiciary Committee ordered the nomination reported to the Senate for consideration. On December 24, 2009, the nomination was returned to the President under the provisions of Senate Rule XXXI, paragraph 6 of the Standing Rules of the Senate. President Obama again nominated Mary L. Smith to be the Assistant Attorney General for the Tax Division on January 20, 2010. On February 4, 2010, the Judiciary Committee ordered the nomination reported to the Senate for consideration. On August 5, 2010, the nomination was returned to the President under the provisions of Senate Rule XXXI, paragraph 6 of the Standing Rules of the Senate.
